RE: Child Nutrition Reauthorization 2010: Area Eligibility for Family Day Care Homes

Effective October 1, 2010, The Healthy, Hunger-Free Kids Act of 2010, Public Law 111-296 revised requirements to allow family day care homes to be classified as tier I for the purpose of reimbursement under Child and Adult Care Food Program (CACFP) if the home is located in an area served by any school in which at least 50 percent of the enrolled children are eligible for free and reduced price school meals.

Previously only the enrollment of the local elementary school could be used to determine tier I eligibility. In Oregon, an elementary school is defined as grades K-8, which has allowed the Oregon Department of Education Child Nutrition Programs (ODE CNP) to allow both elementary and middle school enrollment to be used to make tier I eligibility determinations. The new change now allows high school data to be used when classifying tier 1 homes.

Enclosed are lists of high schools which can now be used to determine tier 1 area eligibility:
  1. 50% or more free and reduced price eligible students
  2. 40-49% free and reduced price eligible students (for census eligibility)
Required Action:
Family Day Care Home Sponsors are required to use this list to re-evaluate the tier classification of all tier 2 homes. If a home now qualifies for tier 1 rates based on the high school data, those providers are eligible to receive tier 1 meal reimbursement for meals served retroactive to October 1, 2010.

By February 28, 2011, Family Day Care Home Sponsors must submit revised reimbursement claims for the affected providers for October, November, and December 2010 in CNPweb. Depending on the month claimed and the date the sponsor enters the revised claim, the revised claim may trigger a one-time exception in CNPweb.

When revising a claim due to retroactive tiering changes, sponsors must send an email to their assigned specialist with the month of the claim and names of providers with tier changes. When the email is received, ODE CNP staff will review and approve the claim; overriding the one-time exception.

ODE CNP will include high schools on the October 2010 school list, which will be published in February 2011.
