Enclosed are two (2) policy memos issued by USDA for National School Lunch Program and School Breakfast Program sponsors. Please review these memos carefully for aspects that pertain to your meal program(s).
Schools Program Policy Memo 35-2009
: Questions & Answers for Milk Substitution for Children with Medical or Special Dietary Needs (non-Disability)
The Questions and Answers clarify various issues concerning the substitution of fluid milk in non-disability cases.

Schools Program Policy Memo 38-2009
: Extending Categorical Eligibility to Additional Children in a Household
Modifies the policy related to categorical eligibility for free meals or free milk for children who are member of a household receiving assistance under the SNAP, FDPIR or TANF Program. If a child in the household is qualified for free meals or milk under SNAP, FDPIR or TANF by direct certification or application, all the children in the household qualify for free meals or milk without further documentation.
