Re: Suspension of Division 22 Assurances for 2012-2013
Oregon law requires that all public schools and districts meet standards set by the State Board of Education (ORS 327.103). The Division 22 Standards for K-12 Education within the Oregon Administrative Rules (OARs) includes the rules that describe a “standard school district.” An Oregon school district, to be standard, must provide acceptable educational opportunities for all Oregon students who reside in the district. To verify compliance with the Division 22 Standards, each year, school districts submit an Assurance form to the Deputy Superintendent of Public Instruction signed by the District Superintendent.
Section 15 (1)(a) of SB 1581, passed by the 2012 State Legislature, required the Oregon Education Investment Board to direct the State Board of Education to waive compliance reporting requirements for the 2012-2013 fiscal year. At the May 2012 meeting of the State Board of Education, the Board waived the Division 22 reporting for districts entering into achievement compacts. The statement of assurance for Division 22 is not required for the 2012-13 school year; however, schools must still abide by Division 22 standards.
The Oregon Department of Education (ODE) continues to work with various stakeholders on the review and revision of the Division 22 standards and of the assurance process. ODE will provide guidance to school districts for the 2013-2014 school year assurances when the revised rules and processes are adopted by the State Board of Education.
